*When patrons order prints, negatives or transparencies of materials for which CSL does not own a
negative, a negative will be made and the $15.00 fee will be charged to patron. The negative will be
retained by CSL.
Orders with originals larger than 18 x 22 20 x 24 will be charged an additional $15.00 set-up fee.
Orders with originals larger than 20 x 24 will be charged an additional $35.00 set-up fee.
Prepayment to the photographer is required for all orders. The photographer will contact the patron
regarding the total cost of the order within 1-2 business days after the order has been picked up from
the library. The California State Library cannot accept payment for orders.

Items larger than 11 x 14 will require additional shipping charges. Items will be shipped via U.S.
Postal Service, unless patron requests otherwise. All such fees will be determined by the photo lab
and will be billed to the patron.

Copyright and Fair Use
The copyright law of the United States (Title 17, U.S. Code Section 101, et seq.) governs the making of photocopies or
other reproductions of copyrighted material. Under certain conditions specified in the "fair use" provision of copyright law,
libraries and archives are authorized to furnish users a photocopy or reproduction. The photocopy or reproduction may be
used "for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use),
scholarship or research," but not for commercial purposes (17 U.S. Code Section 107.)
If a user makes a request for, and later uses, a photocopy or reproduction for purposes in excess of "fair use," that user
may be liable for copyright infringement. The California State Library reserves the right to refuse to accept a reproduction
order if, in its judgment, fulfillment of the order would involve violation of copyright law.
It remains the user's responsibility to determine the copyright status of any material provided by the library. Copyright has
not been assigned to California State Library. The library can claim only physical ownership of the material. The user must
obtain the required permission from a copyright owner before using material from the collection or from the web site if the
intended use of the material would exceed "fair use" limits.
The California State Library permits "fair use," as described above, of documents and images from its collections and web
site for private study, scholarship, teaching, criticism, news reporting, comment, or research only. Publication, exhibition,
commercial use, or reproduction of any material from the California State Library's collections, in either physical or digital
form, is prohibited without prior written permission of the California State Library.
Permission to Use
The vast majority of the images contained in the California State Library collections that were produced or published prior
to 1923 are public domain images. The library does not research each image in its collection to determine or guarantee
freedom from copyright. The library can claim only physical ownership of the material. Materials may be protected by
copyright, trademark, or related interests, including possible rights of privacy. All responsibility for questions of copyright
liability and release violations that may arise in the use made of reproduced material is assumed by the user.
If you would like to use photographs from our collection for publication or exhibit purposes, please submit a letter
requesting permission to use our images. In the letter, please include all known filing elements, negative numbers, and a
copy of each of the photographs that you want to publish. This information is needed to assure proper identification of the
image. Also, please include complete information about your project, including:
· an explanation of how the images will be used,
· the publisher or sponsor,
· the print run and/or production numbers,
· a circulation estimate,
· whether the image is being used for non-profit purposes.
Materials obtained from the California State Library must be published unaltered and in their entirety unless the alterations
are approved in advance and in writing by the library. The library gives no exclusive rights for the use of its materials.
Permission is granted for a one-time use only.
The California State Library reserves the right to refuse permission to publish or exhibit materials if, in its judgment,
publication or exhibition would involve violation of copyright law, would cause irreparable damage to valuable and fragile
originals, or for any other reason.
At present, we charge no commercial usage fees for use of our photographs. In lieu of usage fees, however, we request
that a donation be made to the California State Library Foundation. This donation amount is not a copyright fee.
Donations help to ensure that the library is able to continue to acquire, preserve, and provide access to the materials in its
collection. Donation amounts are determined by the curator of special collections at the time of the permission request.
Information on how the credit line should appear, the California State Library Foundation address, and tax ID information
will be provided in the letter granting permission to publish.
The library requests and gratefully accepts donations of publications or media containing materials from its collections.
