                                               Release of Liability Agreement
 
To: Firemint
Together with this release, I am submitting to you a game concept, script, design or written work
currently titled:

                  Work 1: ____________________________________________________

                  Work 2: ____________________________________________________

                  Work 3: ____________________________________________________

                                        (These will be referred to as the "Material" in the rest of this Agreement.)

I warrant that:
          1. I am at least eighteen years of age.
          2. I am the sole owner and author of the Material and I have the exclusive rights and
          authority to submit the Material to you on the terms and conditions stated in this
          Agreement.
          3. If the Material is based on a real person or a previously published or produced work, I
          warrant that I have authorised rights to market the Material.
I understand and agree that:
          4. As a general rule, Firemint does not purchase game concepts, scripts, designs or other
          similar written work.
          5. Firemint and its clients may have access to, create, or have created concepts, materials
          and ideas, which may be similar or identical to the Material in theme, idea, plot, format or
          other respects. I will not be entitled to any compensation because of the use by Firemint
          or any of its clients of any such similar material, which may have been independently
          created by Firemint or its clients or may have come from any other independent source.
          6. It is my responsibility to protect my work by copyrighting it.
          7. I retain all rights to submit this or similar material to persons and/or entities other than
          Firemint.
I agree that:
          8. I indemnify Firemint and its representatives of and from any and all claims, loss or
          liability (including reasonable attorney's fees) that may be asserted against them at any
          time in connection with the Material.


I hereby state that I have read and understood this Agreement and that no oral representations
of any kind have been made to me, and that this Agreement states our entire understanding with
reference to the subject matter it covers. Any modification of waiver of any of the provisions of
this Agreement must be in writing and signed by both of us.
